Dispatchers aren't allowed. So far, I've done the rule 5 with affidavit of service, then "reminder" letters with another affidavit of service 35 days thereafter then again every 14 days until trial. By not giving the troopers an excuse that "I didn't get the request", I've gotten allot of cases dismissed for fail to produce the materials. Don't waste your time with the supervisors. It is a conspiracy. Our local magistrates seem pretty fed up with this as it has been going on for some time. So don't even go the certified route. Just lots of mailings with affidavits. William G. Southern Brokers, Ltd., 277 S.C. 490, 289 S.E.2d 642 (1982). I am not sure that it continues to be good law after adoption of the SCRCP effective 1985; however, judges seem to like both the case and the underlying reasoning of the case. I always thought Tom Pope is the best lawyer in South Carolina but Dan Speights gets Tom's vote. If you have any success with this case, let me know just because I am curious. Thanks. Thomas F.
